Standard Features for Southpoint Condos
Quality brick on exterior elevations, as per plan, with stone accents, as per plan.
Prefinished, maintenance-free, quality siding (width of siding determined by Vendor – approximately 4” to 7” wide), soffits, fascia and eavestroughs as per elevation.
To maintain an aesthetically pleasing streetscape the Vendor reserves the right to require specific features on the exterior of the home (e.g. stone in lieu of brick).
Maintenance-free, prefinished, vinyl casement windows (on main level) with coloured exterior window frames and grilles (on some windows), with screens on operable windows. If applicable, two windows (not transoms) in the master bedroom, great room, and second bedroom will be operable. All glazing areas are subject to requirements of the Ontario Building Code (OBC). In the event the glazing does not meet the requirements of the OBC the Vendor reserves the right to change window and door sizes to comply with OBC requirements and the Purchaser agrees to pay for the changes (if applicable).
Three 36”x24” sliding basement windows with white exterior frames. All glazing areas are subject to the requirements of the Ontario Building Code (OBC).
The OBC has requirements for the amount of glazing required for a bedroom that is finished in a basement – these requirements may mean there must be more than one window in a finished basement bedroom.

All units that require one or two steps from the rear porch top to the final grade (as determined by the approved unit grading plan) will have grey manufactured stone ‘Ready Steps’ installed and there will not be a railing installed beside the steps – the bottom step will be installed in a bed of stone.
All units that require more than two steps from the rear porch top to the final grade (as determined by the approved unit grading plan) will have designer series Sienna Micro Pro wood steps installed with the maintenance free railing & spindles system on both sides of the steps – the bottom of the steps will be installed on two patio stones.

The Vendor, if required by the municipality the house is being constructed in, will install a soil gas mitigation system that is in compliance with the requirements of the Ontario Building Code. The Vendor will not install a soil gas mitigation system if the municipality the house is being constructed in does not require it. All aspects of the soil gas mitigation system, including but not limited to the design, the location, and the technical specifications are determined at the sole discretion of the Vendor.
Stair treads as per plan (main floor to basement) are carpeted and meet OBC requirements – some plans treads are approximately 10” to 11.5” deep.
Kitchen cabinets, and bathroom vanity(ies), selected from Vendor’s samples as per plan & model type.
Kitchen cabinets include 1 bank of pots and pans drawers (1 bank = 2 drawers), location selected at cabinetry selection meeting.
Flooring selections to be chosen from Vendor’s samples (vinyl tile flooring in foyer, the bathroom(s), kitchen, one eating area, and back entry, - Vendor reserves the right to determine location of all flooring transition locations) all other flooring to be carpet including the stairs where applicable).
In making colour and material selections and upgrades the Purchaser acknowledges being advised that ceramic tile, vinyl flooring and carpeting are subject to pattern, shade and colour variations, and that hardwood flooring is subject to natural variations in colour and grain. Furthermore, hardwood flooring is made of a natural material which is subject to natural shrinkage and expansion and the Purchaser will not hold the Vendor responsible for normal shrinkage and expansion. The Purchaser further acknowledges being advised that the installation of a humidifier where hardwood flooring is installed is recommended.
4" colonial baseboard and 2 5/8" colonial casing for painting throughout (trim may vary in width by 1/8”).

The Purchaser acknowledges that the power-vent gas water heater (“water heater”) to be installed by the Vendor meets the Ontario Building Code requirements and is supplied by a third party on a rental basis and agrees, on closing, to assume the Vendor’s obligations with respect to the water heater in accordance with the third party’s then standard terms and conditions and at the third party’s then standard rental rates and hereby acknowledges the third party’s title and ownership of the water heater. This obligation shall survive the closing of the transaction.

Change Orders: The foregoing specifications supersede any verbal discussions that the Purchaser may have had with the Vendor prior to execution of this agreement. Furthermore, any subsequent alterations to the plan and/or specifications must be in the form of a written change order, signed by both the Purchaser and Vendor.
Satellite TV Wires: The Vendor does not install “rough in” wires for satellite dishes (e.g. attic to elec. panel).
Bulkheads: The Purchaser acknowledges the home may include bulkheads and boxed out walls to accommodate and/or conceal plumbing and mechanical systems. These bulkheads and boxed out walls will vary from home to home and the Vendor reserves the right to install bulkheads and boxed out walls as required. Furthermore, the finishing detail and location of the bulkheads is at the sole discretion of the Vendor.
Warranty: The Purchaser receives substantial warranty protection as set out by the Tarion Warranty Program (in accordance with the Ontario New Home Warranty Act). Under the plan, the Vendor warrants that the house will be free of defects in workmanship and materials for a period of one year. There is a two-year warranty with respect to electrical, plumbing, heating systems, cladding, caulking, windows, and doors, and the building envelope (all parts of the structure that contain the living space is free of water penetration). The Vendor warrants for two years that the basement remains free of water penetration through the foundation. The Purchaser is protected for seven years against major structural defects with the Tarion Warranty Program.
Rebates: Prices include the HST with the rebates assigned to the builder. When the pre-tax sales price exceeds $350,000 the Federal New Housing Rebate is reduced. When the pre-tax sales price exceeds $400,000 the Provincial New House rebate is capped at $24,000. This note is to inform the Purchaser that when an item is added to the house after the agreement is signed that increases the pre-tax sales price the Federal and Provincial Housing rebates will be adjusted and the exact amount the rebate is adjusted will be determined after all selections are finalized and the total rebate will be known at the time the final closing documents are signed at the Purchaser’s lawyer’s office (typically about 2 weeks prior to closing date).
Glass Area: The Ontario Building Code limits the amount of glass (glazing area) in all houses – should the amount of glass area in the house exceed the limit set by the OBC some windows and doors will either have to be removed or changed to a smaller size to ensure the OBC requirement is met – the amount of glass area is calculated at the working drawing review stage.
Pocket Doors: Pocket doors have moving parts – these moving parts will change as time passes and cause the pocket door to rub against the wall of the pocket and operate in a rough manner – these items are not warranted by the Vendor – where possible the Vendor installs a double wall (reduces floor space) to ensure the walls around the pocket door are secure.
Vanity & Cabinet Sizes: All cabinet sizes shown on plans are approximate and subject to change – final cabinet sizes are determined at the cabinetry selection meeting.
Allowances: All allowance amounts noted in Schedule “C” include HST and are not exact prices – exact prices will be provided once a final decision on the product is determined – allowance figures are based on the experience of supplying and installing these products (e.g. a typical ceramic backsplash is $1,200).
Appliances: The Purchaser will need to select all their appliances by the appliance selection date which is typically within two weeks of reaching a firm agreement with Hayhoe Homes - the cabinetry supplier will need to know exact dimensions of appliances in order to produce cabinetry that fits with Purchaser's appliances - failing to select appliances within 2 weeks of firm agreement may result in appliances not fitting in cabinetry spaces provided and/or industry standard opening sizes being installed.
Window Wells: Amount of exposed metal window well (if applicable) seen through any size of basement window is determined by the Engineer's lot grading plan and not by the Vendor - metal window wells (if applicable) have to be installed by the Vendor in order to obtain a grading certificate.
Front Door: The Purchaser will need to have selected the front door and glass style within 10 days of reaching a firm agreement - failing to select a front door style within 10 days of firm agreement will result in the standard front door being installed.
Product Selections: During the sales process many products are on display in Presentation Centres and other houses – the Vendor cannot guarantee that all the same products will still be available at the time selections are made (suppliers can discontinue products without notification). All selections are to be from Vendor’s samples. In the event a selection(s) or detail(s) is in contravention of the Ontario Building Code the Ontario Building Code takes precedence.
Variations in Products: All products are subject to variations in colour, texture, and other esthetic traits of the product. For example, red brick A installed at 123 Apple Street may look different then red brick A installed at 789 Orange Street - there are acceptable variation tolerances in each product and the Vendor cannot guarantee that products will be exactly the same from house to house. The Vendor reserves the right to substitute a comparable, alternative product for any of the products and/or materials included in the construction of the home without the express permission of the Purchaser.
Hard Surface Counter Tops: Pricing for hard surface counter tops can move depending upon the 'grade' of hard surface counter top selected (e.g.: group 1 granite vs. group 4 granite).
8’-4” Tall Foundation Walls: Adding 8’-4” tall foundation walls may result in a railing being added to the porch(s) at the Purchasers expense.
Exterior Railings: Adding exterior railings to a porch (or deck) may result in alterations having to be made to the house to accommodate properly securing the railings. An example of an alteration would be raising the height of a masonry post pad and raising a masonry post pad may result in a change to the size, style, & shape of the PVC post on the masonry post.
Interior Vaulted Ceilings: Interior vaulted ceilings may have to be adjusted or removed from a house if there is not adequate attic space for insulation due to the pitch of the roof on the exterior.
Flush Entry: A cold room cannot be added to a house with flush entry. Flush entry is not available on all lots.
Flush Porch Concrete Porch Tops: Flush concrete porch tops cannot be added to a house with 8’-4” tall foundation walls.
For the Vendor to accept delivery of and take responsibility for any appliance the Purchaser would like delivered to the jobsite prior to the closing date the appliance must be bought at the Vendor’s supplier on the Vendor’s account. Should the Purchaser purchase appliances at the Vendor’s supplier and pay for them on their own person account, credit card, cash, or any other payment means the Vendor will not accept delivery of or take responsibility for any appliance delivered to the jobsite. Should the Purchaser elect to purchase any appliance from any supplier other than the Vendor’s supplier the Purchaser acknowledges they must accept delivery of the appliance(s), have the delivery by the date established by the Vendor (the Vendor may require multiple delivery dates), will pay for multiple delivery dates (if applicable), take full responsibility for the appliance, and acknowledges that should the appliance be damaged in any manner the Vendor is not responsible for the damage and the Vendor will not pay for any replacement costs associated with the damage. The Vendor recommends the Purchaser insure all appliances prior to delivery, at full replacement value. The following items, whether built in or free-standing, are considered for this purpose to be appliances: clothes washers, clothes dryers, refrigerators, microwaves, ranges, cook-tops, ovens, warming drawers and dishwashers. Any item the Vendor deems not an appliance is not permitted to be delivered to the jobsite prior to closing. All appliances delivered to the Vendors jobsite must be compliant with the Ontario Building Code and have been approved by the Vendor.
The Purchaser acknowledges that in order for the Vendor to install some appliances there may be additional charges for adding an additional fuel source (e.g. gas line), connection to fuel source (e.g. connection to the gas line), install of appliance (e.g. install of a slide in gas range), and cabinetry modification charges (e.g. modifications to the cabinetry to accommodate a slide-in range).
